This Privacy Policy explains how Vynth LLC (“Vynth,” “we,” “us,” or “our”) collects, uses, discloses, and protects your information when you visit our website at vynth.ai, use our platform, or interact with any of our services. Vynth operates as a business intelligence and automation platform, and we take the privacy of our visitors, clients, and their customers seriously.

2. Information We Collect

We collect different types of information depending on how you interact with us. We distinguish between three categories of individuals:

a) Website Visitors

When you browse our website, we may automatically collect:

  • IP address and approximate geolocation
  • Browser type, device type, and operating system
  • Pages visited, time spent, and referring URLs
  • Cookies and similar tracking technologies

b) Client Business Owners

When you create an account or use our platform, we collect:

  • Full name, email address, and phone number
  • Business name, industry, and website URL
  • Login credentials (passwords are hashed and never stored in plaintext)
  • Billing information (processed securely through Stripe)
  • Business Profile data you provide (services, hours, descriptions, FAQs, media)
  • Communication preferences and notification settings

c) Client’s Customers (End Users)

When our clients use Vynth to serve their own customers, we may process on the client’s behalf:

  • Customer name, email, and phone number
  • Chat transcripts and conversation history with AI agents
  • Voice call recordings and transcriptions (when voice features are enabled)
  • Appointment bookings and service requests
  • Any additional data the end user voluntarily provides during interactions

For this category, our clients are the data controllers and Vynth acts as a data processor. We process this data solely according to our clients’ instructions and our Data Processing Agreement.

3. How We Use Your Data

We use the information we collect for the following purposes:

  • To operate, maintain, and improve the Vynth platform
  • To create and manage your account and Business Profile
  • To power AI-driven chat and voice agents on behalf of our clients
  • To process payments and manage billing through Stripe
  • To send service-related communications and notifications
  • To analyze usage patterns and improve our services
  • To comply with legal obligations and enforce our terms
  • To protect against fraud, abuse, and unauthorized access

4. AI Processing Disclosure

Vynth uses artificial intelligence to power its platform features. We want to be transparent about how AI processes your data:

Claude API (Anthropic)

We use Anthropic’s Claude API for natural language processing, content generation, and intelligent automation within our platform. Data sent to Claude is processed according to Anthropic’s API Terms of Service. Anthropic does not use API inputs or outputs to train their models. Data is transmitted securely via encrypted connections and is not retained by Anthropic beyond the processing window.

Rosie AI

We use Rosie AI for voice agent capabilities, including inbound and outbound calling, voice transcription, and real-time conversation handling. Voice data is processed in real-time and recordings are stored securely according to our data retention policies. Voice recordings are only made when the calling party is informed and consents.

We do not use your data to train any AI models. AI processing is used solely to deliver the services you or your service provider have requested.

5. Third Parties & Subprocessors

We share data with the following third-party services strictly to operate and deliver our platform. We do not sell your personal information.

6. Data Retention

We retain your data only as long as necessary to provide our services and comply with legal obligations:

  • Account data: Retained while your account is active. Deleted within 30 days of account closure upon request.
  • Business Profile data: Retained while your account is active. Exportable at any time.
  • Chat transcripts: Retained for up to 12 months, then automatically purged unless the client requests earlier deletion.
  • Voice recordings: Retained for up to 90 days, then automatically deleted unless required for dispute resolution.
  • Billing records: Retained for 7 years as required by tax and financial regulations.

7. Your Rights

Depending on your jurisdiction, you may have the following rights regarding your personal data:

  • Access: Request access to the personal data we hold about you and receive a copy in a portable format.
  • Correction: Request correction of any inaccurate or incomplete personal data we hold about you.
  • Deletion: Request deletion of your personal data. We will comply unless retention is required by law.
  • Data Export: Export your Business Profile data in a portable format. Your data belongs to you.
  • Opt-Out: Opt out of marketing communications at any time. Service-related messages are not affected.
  • Withdraw Consent: Withdraw consent for data processing and file a complaint with a regulatory authority.

8. Client Responsibilities

If you are a Vynth client using our platform to serve your customers, you acknowledge and agree to the following:

  • TCPA Compliance: You are responsible for obtaining proper consent before using Vynth’s voice and SMS features to contact your customers, in compliance with the Telephone Consumer Protection Act (TCPA) and applicable state laws.
  • Customer Consent: You must inform your customers that they are interacting with an AI-powered system and obtain any legally required consent for data collection and processing.
  • Recording Disclosure: If voice recording features are enabled, you are responsible for complying with all applicable federal and state recording consent laws, including two-party consent states.
  • Data Accuracy: You are responsible for the accuracy of the Business Profile data you provide, which directly affects the quality of AI interactions with your customers.

9. Cookies

We use cookies and similar technologies for the following purposes:

  • Essential Cookies: Required for the platform to function (authentication, session management, security). These cannot be disabled.
  • Analytics Cookies: Help us understand how visitors use our website (Google Analytics). These can be disabled through your browser settings.

We do not use advertising or third-party tracking cookies. We do not engage in cross-site tracking.

10. Security Measures

We implement industry-standard security measures to protect your data:

  • All data transmitted to and from our platform is encrypted using TLS 1.2+
  • Passwords are hashed using industry-standard algorithms and never stored in plaintext
  • Database access is restricted and monitored with role-based access controls
  • Regular security assessments and dependency audits are performed
  • Infrastructure is hosted on Google Cloud Platform (Cloud Run, Cloud SQL for PostgreSQL) with managed security and automated backups

While we take every reasonable precaution, no method of electronic transmission or storage is 100% secure. We cannot guarantee absolute security.

11. Children’s Privacy

Vynth is not intended for use by individuals under the age of 18. We do not knowingly collect personal information from children. If we become aware that we have collected data from a child under 18, we will take steps to delete that information promptly. 12. International Users

Vynth is based in the United States. If you access our services from outside the United States, please be aware that your data may be transferred to, stored, and processed in the United States where our servers are located. By using our services, you consent to this transfer. We will take reasonable steps to ensure your data is treated securely and in accordance with this Privacy Policy.

13. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. When we make material changes, we will notify you by updating the “Effective Date” at the top of this policy and, where appropriate, through email or platform notifications. Your continued use of our services after any changes constitutes acceptance of the updated policy.
